Early this month, we had reported that OpenSea delisted NFT collection, Caked Apes. The move came after Taylor Whitley filed a DMCA (Digital Millennium Copyright Act) against the project. In the latest development, four members of Caked Apes have sued Taylor in the United States District Court.
Caked Apes is a collection of 8,888 NFTs from the Nxthing World group. The NFTs are currently available for purchase on LooksRare.
Caked Apes Sues Taylor Whitley: All you need to know
According to a copy of the legal complaint seen by NFTevening, Caked Apes is suing Whitley for breach of written contract, breach of fiduciary duty, and violations of DMCA, among others. In his DMCA notice, Whitley had claimed that Caked Apes used his images and some assets without his permission. However, Caked Apes dismissed the claims.
“From day one, Caked Apes has been a collaborative effort with everyone agreeing up front on the fair compensation based on the value that each team member added to the project,” Nxthing World said in a statement. “Each of us has been properly compensated since the inception of this project including Taylor Whitley…”
“By his own admission, [Taylor] contributed no original drawings to the Caked Apes creations,” they added. The team further alleged that Taylor tried to “renege on” their deal and claim a “bigger piece of the pie”. Furthermore, they stated that Taylor allegedly “harassed” and “bullied” the members of the team and the community.
Meanwhile, John Snow, the attorney for the plaintiffs, said, “When our clients were subjected to the actions detailed in the lawsuit, they wanted to shine a light on it. They hope their case will become a shield for the true creatives in their community to defend their rights and prevent something like this from happening again.”
Actually, this is not the first such lawsuit in the NFT space. Recently, the Weather Report NFT project too filed a lawsuit against its former artist.
